3. What Data We Collect

• Contact & booking data: name, phone, email, device model and the details you submit through our forms.
• Repair data: device fault description and diagnostic results, processed solely to carry out the repair.
• Technical data: IP address, browser type, date/time of access and pages viewed, collected in server logs.
• Cookie data: preference and, with consent, analytics identifiers (see section 8).

4. Purposes & Legal Basis

We process your data to answer enquiries and prepare quotes (Art. 6(1)(b) GDPR – pre-contractual measures), to perform repair contracts (Art. 6(1)(b)), to meet legal retention duties (Art. 6(1)(c)), and, based on your consent, for analytics and marketing (Art. 6(1)(a)). We never access personal content stored on your device unless expressly authorised for data recovery.

5. Data Retention

Enquiry data is kept for up to 6 months after last contact. Contractual and invoicing records are retained for 10 years to comply with German commercial and tax law (§ 147 AO, § 257 HGB). Diagnostic data is deleted once the repair is closed.

6. Data Sharing

We share data only where necessary: with shipping partners for mail-in repairs, with payment providers, and with our accountant and hosting provider acting as processors under Art. 28 GDPR data-processing agreements. We do not sell your personal data. No transfer outside the EU/EEA takes place without appropriate safeguards (Standard Contractual Clauses).

7. Your Rights

• Right of access (Art. 15), rectification (Art. 16) and erasure (Art. 17).
• Right to restriction (Art. 18) and data portability (Art. 20).
• Right to object to processing (Art. 21) and to withdraw consent at any time.
• Right to lodge a complaint with a supervisory authority — for Berlin: Berliner Beauftragte für Datenschutz und Informationsfreiheit.
• California residents (CCPA): right to know, delete and opt out of "sale" of personal information. We do not sell personal information.

1. Scope

These Terms & Conditions govern all repair services, quotes and sales between NovaFix Berlin GmbH ("we", "us") and the customer ("you"). By booking a repair or accepting a quote, you agree to these terms.

2. Quotes & Diagnostics

Online calculator prices are non-binding estimates. A binding fixed price is provided after a free diagnostic. No repair work begins without your explicit approval of the final price.

3. Repair Contract

A contract is formed when we accept your booking and you approve the confirmed price. We perform repairs with professional care using original-grade or certified premium parts.

4. Prices & Payment

All prices are in euros and include 19% statutory VAT. Payment is due on completion and collection of the device, or on delivery for mail-in orders. We accept card, PayPal, Apple Pay and cash. Devices are handed over only after full payment.

5. Turnaround Times

Stated repair times (e.g. "60 minutes") are targets and may vary with parts availability or fault complexity. We inform you promptly of any material delay.

6. Warranty

We grant a 24-month warranty on replaced parts and workmanship from the collection date. The warranty excludes new accidental damage, liquid ingress after repair, and third-party tampering. Your statutory warranty rights remain unaffected.

7. No-Fix–No-Fee

If we cannot resolve the reported fault, you pay nothing for the diagnostic or attempted repair. This does not apply where a device is damaged further by prior third-party repair attempts disclosed in advance.

8. Customer Obligations

You confirm you are the owner or authorised holder of the device and are responsible for backing up your data before service. Please remove SIM and memory cards where possible.

9. Uncollected Devices

Repaired devices not collected within 90 days of notification may incur reasonable storage fees. After 6 months, uncollected devices may be recycled in accordance with statutory provisions after a further written reminder.

10. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only for breach of a material contractual obligation, limited to the foreseeable, typical damage. Liability under the Product Liability Act remains unaffected.

11. Governing Law & Jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For merchants, the place of jurisdiction is Berlin. Mandatory consumer-protection provisions of your country of residence remain unaffected.

1. Right of Withdrawal (14 Days)

If you are a consumer in the EU and booked a service remotely (e.g. mail-in or online booking), you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day the contract was concluded.

2. How to Withdraw

You may use the model withdrawal form below, but it is not obligatory. To meet the deadline it is sufficient to send your communication before the withdrawal period expires.

3. Effects of Withdrawal

If you withdraw, we reimburse all payments received from you without undue delay and no later than 14 days from the day we are informed. We use the same means of payment you used, at no extra cost to you.

4. Early Performance / Loss of Right

If you expressly requested that repair work begin during the withdrawal period, you must pay a reasonable amount proportionate to the services already provided. The right of withdrawal expires once the service has been fully performed with your prior express consent and acknowledgement that you thereby lose that right.

5. No-Fix–No-Fee Refunds

If a repair does not resolve the reported fault, no charge applies. Any prepayment for an unsuccessful repair is refunded in full within 14 days.

6. Warranty Refunds

If a repaired fault recurs within the 24-month warranty and we cannot remedy it, you are entitled to a refund of the repair fee for that fault.

7. Return Address for Mail-In
